Terms of Service

TERMS AND CONDITIONS

Last updated: 2 September 2026

These Terms and Conditions ("Terms") govern your access to and use of the website located at eurekalegal.au (the "Site") and the document templates, questionnaires, and related services made available through it (together, the "Services").

By accessing the Site, completing a questionnaire, purchasing a Document, or subscribing to a Membership, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. What EurekaLegal Is

EurekaLegal provides self-serve, customisable legal document templates ("Templates") for personal, family, and business use, available either as a one-time purchase or through a monthly Membership. You complete an online questionnaire, our system uses conditional logic to assemble a document from your answers, and you receive a completed document ("Document") for download.

EurekaLegal is not a law firm and does not provide legal advice. Section 12 below and our separate Legal Disclaimer (/disclaimer) explain this in full — please read it before you rely on any Document.

2. Eligibility

You must be at least 18 years old and capable of forming a legally binding contract under Australian law to use the Services. By using the Site, you confirm this is the case.

3. Accounts

A one-time purchase does not require an account. A Membership does — you'll be asked to create one before subscribing, since your account is where you manage your Membership and access your document history. You're responsible for keeping your login credentials confidential and for all activity under your account.

4. One-Time Purchases: Ordering, Pricing and Payment

4.1 Prices are shown in Australian dollars (AUD) and include GST where applicable.

4.2 Payment is processed by a third-party payment provider (Airwallex). We do not store your full card details.

4.3 We may change our prices at any time. The price that applies to your purchase is the price displayed at checkout.

5. Delivery of One-Time Purchase Documents

5.1 On successful payment, we generate your Document and email you a secure link to download it, in Word and/or PDF format.

5.2 This download link is valid for 14 days from the date of purchase. After 14 days, the link expires and the Document is no longer accessible through it. Because one-time purchases don't include an account, this link is your only way to retrieve the Document — please download and keep your own copy before it expires.

5.3 If your link has expired, contact us at support.eurekalegal@gmail.com. We may, at our discretion, reissue access to the Document on a case-by-case basis, but we don't guarantee this.

6. Refunds — One-Time Purchases

6.1 Because Documents are generated on demand from your own input and delivered instantly, we do not offer change-of-mind refunds once a Document has been generated.

6.2 If a Document is legally invalid or unusable for its intended purpose because of an error in the Template itself (rather than because of information you provided, or a situation the Template wasn't designed to cover), contact us at support.eurekalegal@gmail.com. We will investigate and, where appropriate, provide a corrected Document, a replacement, or a refund.

6.3 Nothing in this clause 6 excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law (ACL) or any other law that cannot lawfully be excluded.

7. Membership: Pricing, Renewal and Payment

7.1 The Membership is $99.99 AUD per month, GST-inclusive, billed automatically on the same date each month from when you subscribe.

7.2 Your Membership automatically renews every month until you cancel it. Payment is processed by Airwallex using the payment method you provide at signup.

7.3 If a renewal payment fails, our payment processor automatically retries the charge over the following days. If all retry attempts fail, your Membership is automatically cancelled and access ends immediately — see clause 8.5.

8. Membership: Access, Template Selection, and Cancellation

8.1 A Membership gives you unlimited document generation from a set of 30 Templates that you choose from our full library.

8.2 You may update your selection of 30 Templates once per billing cycle. Changing your selection does not affect Documents you've already generated — but see clause 8.4 on what happens to a Template you remove.

8.3 You may cancel your Membership at any time from your account. Cancellation takes effect at the end of your current billing period — you keep full access until then, and you will not be charged again after that date.

8.4 When your Membership ends — whether by cancellation or because it lapses under clause 7.3 — your access to Documents generated under that Membership ends too. This includes Documents made from a Template you've since swapped out of your selection, and Documents made before you cancelled. If you want to keep a Document, download it before your access ends.

8.5 A Membership that lapses because payment failed (clause 7.3) ends immediately, with no grace period — this is different from cancelling voluntarily under clause 8.3, where you keep access until the end of the period you already paid for.

8.6 You may re-subscribe at any time, including immediately after cancelling — there's no waiting period.

9. Intellectual Property and Licence to Use Templates

9.1 All Templates, questionnaire logic, site content, and underlying software are owned by EurekaLegal or our licensors and are protected by copyright and other intellectual property laws.

9.2 Once you receive a completed Document — whether through a one-time purchase or a Membership — it's yours to use, edit, and adapt freely for your own personal or internal business purposes.

9.3 You may not resell, redistribute, sublicense, or publish the blank Template itself (as distinct from your own completed Document), or use our Templates, questionnaire structure, or Site content to build or supply a competing product or service.

10. Acceptable Use

You agree not to:

(a) use the Site for any unlawful purpose, including to generate a document intended to mislead, defraud, or evade a legal obligation;
(b) attempt to gain unauthorised access to the Site, our systems, or another user's account or data;
(c) interfere with or disrupt the Site's operation, including by introducing malware or attempting a denial-of-service attack;
(d) submit false information about another person without their knowledge, where that information will appear in a legal document affecting them.

We may suspend or terminate access for anyone who breaches this clause.

11. Third-Party Services and Links

The Site may use or link to third-party services (payment processing, hosting, email delivery, and analytics providers). We're not responsible for the content, accuracy, or practices of third-party services, and your use of them is governed by their own terms.

12. No Legal Advice

EurekaLegal is not a law firm and nothing on the Site constitutes legal advice — this applies equally to one-time purchases and to unlimited generation under a Membership. Having ongoing access to generate documents doesn't change what the service is: general, standardised drafting for common situations, not advice tailored to you. See our full Legal Disclaimer (/disclaimer).

13. Warranties and Liability

13.1 To the extent permitted by law, the Site and Services are provided "as is."

13.2 Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the ACL or any other law that cannot lawfully be excluded. Where you are a consumer within the meaning of the ACL, our liability for failure to comply with a consumer guarantee is not limited by this clause.

13.3 To the extent you are not acquiring the Services as a consumer for personal, domestic, or household use, and to the extent permitted by the ACL, our liability for breach of a non-excludable guarantee is limited, at our option, to re-supplying the Services or paying the cost of having them supplied again.

13.4 Subject to clauses 13.2 and 13.3, and to the maximum extent permitted by law, our total liability to you is limited to the total amount you paid us in the 12 months before the event giving rise to the claim, and we are not liable for indirect, special, or consequential loss.

14. Indemnity

To the extent permitted by law, you agree to indemnify EurekaLegal against any loss, damage, or claim arising from your breach of these Terms, your misuse of the Site, or a Document you generated using false or misleading information about a third party.

15. Termination

We may suspend or terminate your access to the Site if you materially breach these Terms. Clauses that by their nature should survive termination (including intellectual property, liability, and indemnity clauses) continue to apply after your access ends.

16. Changes to These Terms

We may update these Terms from time to time. Where a change is material, we will give reasonable notice — for example, by posting an updated version with a new "Last updated" date, or by email if you have an account.

17. Privacy

Our collection and handling of your personal information is set out in our Privacy Policy (/privacy), which forms part of these Terms.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State and the Commonwealth of Australia. This does not remove any right you have to bring proceedings in your own state or territory of residence under the ACL.

19. Complaints and Dispute Resolution

Contact us first at support.eurekalegal@gmail.com — we aim to resolve most issues directly. If you're not satisfied with our response, you can raise unresolved consumer complaints with your state or territory consumer affairs body, or the ACCC.

20. General

20.1 Severability — If any part of these Terms is unenforceable, the rest continues to apply.

20.2 No waiver — Failing to enforce a term is not a waiver of our right to enforce it later.

20.3 Assignment — We may assign or transfer our rights under these Terms. You may not assign your rights without our consent.

20.4 Force majeure — We're not liable for delay or failure to perform caused by events outside our reasonable control.

20.5 Entire agreement — These Terms, the Privacy Policy, and the Legal Disclaimer are the entire agreement between you and us regarding the Services.
